1. Acceptance of Terms & Regulatory Framework

By accessing, installing, or using DripSwap, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and DripSwap Technologies, a business registered with the Patents and Companies Registration Agency (PACRA) of Zambia under Business Name Registration No. 320251060462. If you do not agree to every provision explicitly stated here, you must immediately cease using our platform.

2. Age Restriction — 18 and Older Only

DripSwap is strictly for use by individuals aged 18 and older. By creating an account or otherwise using the platform, you confirm that you are at least 18 years old. Account creation requires you to explicitly check a box confirming this before you can proceed. DripSwap does not knowingly permit anyone under 18 to register or use any part of the platform, including browsing, buying, selling, requesting deliveries, or attending events.

If DripSwap becomes aware that an account belongs to someone under 18, that account — and the personal data associated with it — will be suspended and deleted without prior notice.

3. Platform Nature: Logistical & Ticketing Intermediary

DripSwap is a digital infrastructure hub for P2P logistics and event ticketing. DripSwap acts solely as a technical software intermediary pairing independent sellers with independent courier operators, and event attendees with event organizers. DripSwap does not host events, own transport fleets, or manufacture goods; we provide the digital verification layer to facilitate these connections.

DripSwap is not an escrow service. DripSwap does not hold, safeguard, or guarantee funds on behalf of buyers, sellers, or event attendees. Payment for goods, services, or event entry is arranged and settled directly between the parties involved; DripSwap is not a party to, and accepts no liability for, that payment.

4. Event Ticketing & Digital Passes

DripSwap serves as a digital ticketing utility, allowing organizers to issue and attendees to reserve digital event passes. Currently, all events on DripSwap operate on a "Pay at Door" basis.

  • Role of the Pass: A digital pass generated by DripSwap serves as a valid reservation for entry. It is a technical substitute for a physical ticket.
  • Payment at the Door: DripSwap facilitates the reservation only. The financial settlement for entry occurs physically between the Attendee and the Event Organizer at the venue. DripSwap bears no responsibility for entry disputes, gate access, or payment collection discrepancies at the venue.
  • Organizer Responsibility: Event Organizers are solely responsible for verifying digital passes at the gate, managing venue capacity, and handling all cash/payment transactions collected at the door.
  • Attendee Risk: Attendees acknowledge that reserving a pass via DripSwap does not guarantee entry if the venue reaches legal capacity or if the Event Organizer denies access for venue-specific reasons.

5. Content Ownership & Marketing Rights

By uploading content to DripSwap, you grant DripSwap Technologies a worldwide, royalty-free license to use, reproduce, and display such content within the DripSwap platform itself (including the Drip feed, Market listings, trending and featured sections, and other in-app placements) in order to operate and promote the platform to its existing users.

For Influencers & Creators: You acknowledge that DripSwap may use your public profile assets for general in-platform promotion (e.g., in-app trending or featured placements) as described above, without additional consent.

External Marketing Requires Your Consent: DripSwap will not use your content outside the platform — including on DripSwap's own social media accounts (Facebook, TikTok, Instagram, etc.), paid advertisements, press or media materials, or any other external marketing channel — without your prior, explicit consent. Where you provide such consent, you may specify the scope and duration it applies to, and DripSwap will not use your content beyond what you've agreed to, or after that duration has passed. For major commercial campaigns using your specific primary brand identity, DripSwap will still seek a separate mutual agreement regardless of any general external-marketing consent given.

6. Prohibited Content & Sole User Liability

DripSwap maintains a strict zero-tolerance policy for prohibited content and conduct, including pornography or explicit adult material, illegal/dangerous cargo, graphic violence, hate speech, harassment or bullying of other users, deceptive scams, and content involving or targeting minors in any way. You are solely and exclusively responsible for the legality of your listings, event descriptions, posts, and conduct toward other users. Any civil, criminal, or regulatory consequences resulting from your content or conduct are your personal liability. DripSwap disclaims any structural responsibility for third-party user uploads, but reserves the right to remove content, suspend, or permanently ban any account engaged in harassment, bullying, or the prohibited conduct described above.

7. Prohibited Items for P2P Delivery

To ensure the safety of our independent couriers and compliance with Zambian law, the following items are strictly prohibited from being transported via the DripSwap platform.

  • Dangerous and Hazardous Materials: Firearms, ammunition, explosives, fireworks, flammable liquids, corrosive chemicals, and toxic substances.
  • Illegal and Heavily Regulated Goods: Narcotics, illicit drugs, unregistered prescription medications, stolen property, and counterfeit goods.
  • High-Risk Financial Instruments: Bulk cash (fiat currency), bullion, loose precious stones, and bearer bonds.
  • Live Animals and Unpackaged Perishables: Live animals, insects, and raw/unpackaged meat or highly perishable food items lacking standard commercial cold-chain packaging.
  • Obscene or Offensive Material: Any materials prohibited by local law or deemed universally offensive.

User Liability & Right of Refusal:

  • Inspection: DripSwap independent couriers reserve the right to visually inspect any unsealed package before transport to verify compliance with this list.
  • Immediate Termination: Attempting to transport prohibited items will result in an immediate, permanent ban from the DripSwap platform.
  • Indemnification: The Sender assumes full civil and criminal liability for any prohibited items handed to a courier. DripSwap and its network of couriers accept zero liability for the loss, confiscation, or legal consequences of transporting undeclared prohibited goods. We reserve the right to report severe violations to the relevant local authorities.

8. Fees & Refund Policy

Posting a listing and requesting a delivery on DripSwap is free, and unlocking a matched courier's contact details is free as well. DripSwap Technologies' own service fees — verification badges, Pro status, and visibility boosts, processed securely through our pawapay gateway — are the only payments that pass through DripSwap. Payment for the underlying goods, services, or event entry you buy or sell from another user is not processed by DripSwap and is arranged directly between the parties involved; as stated in Section 3, DripSwap does not hold, safeguard, or release such funds.

Standard No-Refund Policy: Due to the digital nature of our services, all transactions — including profile verifications, Pro status, and visibility boosts — are generally final and non-refundable once activated.

System Failure Exception: In the rare event of a verified DripSwap server crash, payment gateway timeout, or technical failure where funds are deducted from your mobile money account or card but the digital service (badge, Pro status, or boost) is not successfully provisioned to your profile, you are entitled to a refund or manual activation. Claims must be reported to DripSwap Support within 48 hours of the transaction.

9. Limitation of Liability

DripSwap provides the routing and ticketing architecture but does not control the events or items listed. DripSwap carries zero direct insurance liability for items lost during transit or issues arising from event attendance. In the event of confirmed gross misconduct by a third-party courier or event organizer, DripSwap's absolute maximum liability is strictly restricted to the value of the service fee, if any, used to initiate the transaction.

10. Unilateral Termination

DripSwap Technologies reserves the unconditional right to suspend, shadow-ban, or delete any account or event listing without prior notice or compensation for violations of these terms, including fake ticketing, harassment or bullying of other users, pornography, or being under the age of 18.
